Street Blocking Permit

There are two types of street blocking permits, the Standard Permit and the Comprehensive Permit.

As provided in Chapter 8.7 Dayton Municipal Code (DMC), a street blocking permit is required if the intention is to block or close any or all of a city street, alley, sidewalk or any other public right of way for any length of time. In order to obtain a permit, you must make application to the Public Works Director (“Director”) at least ten (10) business days prior to the date that the street block/closure is to begin.    

STANDARD STREET BLOCKING PERMIT

If your street is anticipated to be blocked seven (7) days or less in length you must make application for a Standard Street Blocking Permit. 

The City requires the following information for a Standard Street Blocking Permit (DMC 8.7.040), including, but not limited to:

• Description of the Intended use for the city’s street, alley or right of way during the block.
• Description of the city’s street, alley or right of way to be blocked.  The Director may request a map representing the proposed blockage.
• Specific date(s) and time(s), that the same shall be blocked. A minimum of one-way vehicular traffic access must be maintained during the hours of 5:00 p.m. to 7:00 a.m. each day on the blocked streets, alleys or right of ways.
• Statement that the permittee shall be responsible for all traffic control and assumes the responsibility to maintain appropriate signage, signals and barricades that protect the public safety, in accordance with the Manual on Uniform Traffic Control Devices (MUTCD). At the discretion of the Director, applicant may be required to provide a traffic control plan in accordance with the MUTCD.
• Statement that the applicant agrees to hold the City of Dayton harmless by reason of such blocking.
• Provide proof of liability insurance coverage when requested by the Director or designee.
• Statement that the applicant agrees to repair any damages done to the city’s street, alley or right of way as required by the Public Work Development Standards, Specifications and Standard Plans and that the area shall be left in a clean condition.

A Standard Street Blocking Permit shall be issued if the following criteria are met:

• The Director determines that the applicant submitted a complete application in accordance with DMC 8.7.040.
• Street Blocking Permit Fees paid in full (See Master Fee Schedule for current fee structure)

 COMPREHENSIVE STREET BLOCKING PERMIT

If the street blocking shall occur longer than seven (7) days a you must make application for a Comprehensive Street Blocking Permit.  

The City requires the following information for a Comprehensive Street Blocking Permit including, but not limited to:

• Intended use for the city’s street, alley or right of way during the block.
• Description of the city’s street, alley or right of way to be blocked.  If applicant proposes to block multiple streets, the Director may request a map summarizing the areas to be blocked.
• Specific date(s) and time(s), that the same shall be blocked. A minimum of one-way vehicular traffic access must be maintained during the hours of 5:00 p.m. to 7:00 a.m. each day on the blocked streets, alleys or right of ways.
• Statement that the permittee shall be responsible for all traffic control and assumes the responsibility to maintain appropriate signage, signals and barricades that protect the public safety, in accordance with the Manual on Uniform Traffic Control Devices (MUTCD). At the discretion of the Director, applicant may be required to provide a traffic control plan in accordance with the MUTCD.
• Statement that the applicant agrees to hold the City of Dayton harmless by reason of such blocking.
• Provide proof of liability insurance coverage for the minimum amount of $1,000,000 (One Million Dollars).
• Statement that the applicant agrees to repair any damages done to the city’s street, alley or right of way as required by the Public Work Development Standards, Specifications and Standard Plans and that the area shall be left in a clean condition.

Applicant shall be required to provide a report each day listing the likely time, location, and severity, of the blockings in the forthcoming workday.  Such report shall be delivered to the Director, Fire District 3 and the Columbia County Sheriff’s Office prior to commencing work for the day.

A Comprehensive Street Blocking Permit shall be issued if the following criteria are met:

• The Director determines that the applicant submitted a complete application in accordance with DMC 8.7.050.
• Street Blocking Permit Fees paid in full (See Master Fee Schedule for current fee structure).

If an Applicant is denied a street blocking permit, the applicant may appeal the denial of the application at the next regular City Council meeting at provided in DMC 8.7.070.

It is the Permittee’s responsibility to furnish the Columbia County Sheriff’s Office, Fire District 3, City Planning Department and City Clerk’s Office with a copy of the issued permit.

Failure to comply with the provisions of Title 8 Chapter 7 of the DMC, may result in a violation and penalty (DMC 8.7.090).
